Terms & Conditions

General


By 


(i) using this Application or any facility or Service provided by this Application in any way; or 


(ii) merely browsing the Application, You agree that You have read, understood and agreed to be bound by these Terms and Conditions, Return and Cancellation policy, delivery information and the Applications’s Privacy Policy available at the homepage, www.ishop.ind.in.


iShop (Indore Dresses Pvt Ltd.) shall not be required to notify You, whether as a registered user or not, of any changes made to the Terms and Conditions. The revised Terms and Conditions shall be made available on the Application. Your use of the Application and the Services is subject to the most current version of the Terms and Conditions made available on the Application at the time of such use. You are requested to regularly visit the home page www.ishop.ind.in to view the most current Terms of Use. You can determine when iShop (Indore Dresses Pvt Ltd.) last modified the Terms of Use by referring to the "Last Updated" legend above. It shall be your responsibility to check these Terms and Conditions periodically for changes; iShop (Indore Dresses Pvt Ltd.) may require you to provide your consent to the updated Terms and Conditions in a specified manner before prior to any further use of the Application and the Services is provided on the Application. If no such separate consent is sought, your continued use of the Application, following changes to the Terms and Conditions, will constitute your acceptance of those changes.


If a buyer does not provide his/her business firm's GST Registration Number, then addition of GST number to his invoice later is at the sole discretion of iShop (Indore Dresses Pvt Ltd.)  and possible only within same calendar month. In the same manner, if GST details are provided for an order, we will automatically update the GST number in subsequent orders placed from same mobile number and removal of the same may not be possible after the same calendar month.


Eligibility of Use


The Services are not available to minors under the age of eighteen (18) or to any Users suspended or removed from the iShop (Indore Dresses Pvt Ltd.) system. You represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws as applicable in India. Notwithstanding the foregoing, if you are below the age of eighteen (18) years, you may avail the Services provided by iShop (Indore Dresses Pvt Ltd.) through your legal guardian in accordance with the applicable laws.


iShop (Indore Dresses Pvt Ltd.) reserves the right to refuse access to use the Services offered at the Application to new Users or to terminate access granted to existing Users at any time without according any reasons for doing so.


You shall not have more than one active Account on the Application. Additionally, you are prohibited from selling, trading, or otherwise transferring Your Account to another party.


User Account, Password and Security


The Application requires you to register as a User by creating an Account in order to avail of the Services provided by the Application. You will be responsible for maintaining the confidentiality of the Account Information, and are fully responsible for all activities that occur under Your Account. You agree to (a) immediately notify iShop (Indore Dresses Pvt Ltd.) of any unauthorized use of Your Account Information or any other breach of security, and (b) ensure that You exit from Your Account at the end of each session. iShop (Indore Dresses Pvt Ltd.) cannot and will not be liable for any loss or damage arising from Your failure to comply with this Section. You may be held liable for losses incurred by or any other user of or visitor to the Application due to authorized or unauthorized use of Your Account as a result of your failure in keeping Your Account Information secure and confidential.


The Application also allows restricted access to the Services for unregistered Users.


You shall ensure that the Account Information provided by you in the Application's registration form is complete, accurate and up-to-date. Use of another user's Account Information for availing the Services is expressly prohibited.


If You provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or iShop (Indore Dresses Pvt Ltd.) has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, iShop (Indore Dresses Pvt Ltd.) has the right to suspend or terminate Your Account and refuse any and all current or future use of the Application (or any portion thereof).

Pricing Information

You agree to provide correct and accurate credit, debit card, or Banks details, UPI account to the approved payment gateway for availing Services on the Application.You shall not use the credit/ debit card, Bank account, UPI account which is not lawfully owned by You,i.e. in any transaction, You must use Your own credit/ debit card or bank account, UPI account. The information provided by You will not be utilized or shared with any third party unless required in relation to fraud verification or by law, regulation or court order. You will be solely responsible for the security and confidentiality of Your credit/ debit card, bank details, UPI account. iShop (Indore Dresses Pvt Ltd.) expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of Your credit/ debit card, bank account, UPI account.


Disclaimer

Pricing on any product(s) as is reflected on the Application may due to some technical issue, typographical error or product information published by the seller may be incorrectly reflected and in such an event seller may cancel such your order(s). You release and indemnify iShop (Indore Dresses Pvt Ltd.) and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Users of the Application and specifically waive any claims that you may have in this behalf under any applicable law. Notwithstanding its reasonable efforts in that behalf, iShop (Indore Dresses Pvt Ltd.) cannot take responsibility or control the information provided by other Users which is made available on the Application. You may find other User's information to be offensive, harmful, inconsistent, inaccurate, or deceptive. Please use caution and practice safe trading when using the Application.



User Obligations

Subject to compliance with the Terms of Use, iShop (Indore Dresses Pvt Ltd.) grants You a non-exclusive, limited privilege to access and use this Application and the Services provided therein. You agree to use the Services, Application and the materials provided therein only for purposes that are permitted by: (a) the Terms and Conditions; and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

You agree to adhere to all limitations on dissemination, use and reproduction of any materials (such as the product catalogs) that You access on the Application in accordance with next Section.


Use of Material

Except as expressly indicated to the contrary in any applicable Additional Terms, iShop (Indore Dresses Pvt Ltd.)  hereby grants You a non-exclusive,freely revocable (upon notice from iShop (Indore Dresses Pvt Ltd.) ), non-transferable access to view, download and print product catalogs or any other materials available on the Application, subject to the following conditions:

 • You may access and use the materials solely for personal, informational, and internal purposes, in accordance with the Terms of Use;

 • You may not modify or alter product catalogs or any other materials available on the Application;

 • You may not distribute or sell, rent, lease, license or otherwise make the product catalogs or any other materials available on the Application, available to others; and

  •You may not remove any text, copyright or other proprietary notices contained in the product catalogs or any other materials available on the Application.

  •Subject to Indore jurisdiction only

  •iShop (Indore Dresses Pvt Ltd.)  reserves the right to disqualify any user who has not acted on good faith basis



Credit Facility

  •Buyers showing interest in credit facility would require to contact iShop (Indore Dresses Pvt Ltd.). And iShop (Indore Dresses Pvt Ltd.) will decide Credit request will be processed or rejected.

  •iShop (Indore Dresses Pvt Ltd.) reserves full rights to approve or reject and to assign limits based on their underwriting criteria and are not liable to disclose any parts of its credit policy under any circumstances.

  •In case of a delay in repayments from the stipulated payment schedule and timelines, iShop (Indore Dresses Pvt Ltd.) reserves full rights to report the delay to the credit bureau and beyond a 7 days delay beyond the due date may also report this as a case of willful default hurting a borrower's credit rating permanently. Under no circumstances post such reporting to the bureau, iShop (Indore Dresses Pvt Ltd.) is not going to be held liable of any damage to the client's credit history and losses arising out of it.

   •To approve better credit limits and for better underwriting, iShop (Indore Dresses Pvt Ltd.) may use buyers profile information using various allowed permissions from user's android or ios profile and the user gives all rights to iShop (Indore Dresses Pvt Ltd.) for using this data. 

   •By Submmitting PAN card number, user is fully acknowledging and agreeing to, " I hereby authorize  and give consent to iShop  and Indore Dresses pvt. ltd to disclose, without notice to me ,all  information furnished by me in relation to the facilities availed from subsidiaries/affiliates/ Credit Bureaus/Services Providers, governmental/regulatory authorities or third parties for KYC information verification, credit risk analysis, or for other related purposes that iShop  may deem fit."

   •User agrees that his transnational volumes on the POS Machines / QR Code / POS Billing software provided through iShop (Indore Dresses Pvt Ltd.) tie-ups may be used to assess the business volumes of the client and hence used in calculating the eligibility of his credit limits.  



Resell

  •Business buyers from iShop (Indore Dresses Pvt Ltd.) can resell "UNBRANDED" goods to any online commerce. 

  •Business buyers from iShop (Indore Dresses Pvt Ltd.)  can not resell "BRANDED" goods to any online commerce without valid NOC from specific brand. iShop (Indore Dresses Pvt Ltd.) will assist end buyer to get valid NOC from a specific brand.  For any clarification, contact iShop (Indore Dresses Pvt Ltd.) Sales.


iShop (Indore Dresses Pvt Ltd.) rights and users duties


  •If any wrong input given by customer for city  or address or state or district or pin code or mobile number or gst number or aadhar number or pan card number or email id, then we’ll not be liable for any damages arising because of wrong information

  •Keep your (customer) password to yourself, and do not share it to anyone.

  •Customer on his will, to sign up, will share its data with us.

  •We will not ask you for your password details.

  •We can change portal or front end or application fields’ data anytime as per our will to show customer.

  •If product received in parcel with some other brand name then it would not be our liability as it may happen that brand name on portal or front end or application field entered different from what the actual brand name is. And on this ground, customer can’t place purchase return to us.

  •Sometimes product will not match its head category, so, category is our internal part and we have right to show any category name for that product.

  •If any product is out of stock and payment is received from customer for that product, then we'll refund amount to i-Pay only, and we may also cancel order if product goes out of stock. And, we have the right to do this.

  •We can go server under maintenance anytime and we can do such thing without prior notice.

  •All products which stated on iShop (Indore Dresses Pvt Ltd.) with price are mere invitation to offer and by placing order customer sends us offer in the form of order, and we have right to accept order or reject order.

  •i-Pay is iShop (Indore Dresses Pvt Ltd.)'s created wallet and we have right to maintain it with adding or deducting virtual amount to it and for that customer will be notified, but if no notification is received after being transferred or deducted then customer should contact us within 21 working days otherwise it will be assumed that customer has agreed with i-Pay amount deduction or addition.

  •Live Chat is iShop (Indore Dresses Pvt Ltd.) given chat module in which you would interact with our customer care executive in real time, and our executive will not ask customer for any password details, and will not ask you for amount payment to any other account than given on iShop (Indore Dresses Pvt Ltd.) payment page officially.

  •We iShop (Indore Dresses Pvt Ltd.) is using Bill desk payment Gateway and customer will pay through it.

  •If customer is paying below 50000 then no additional charge will be charged to customer, but from 50001,for every transaction they processing, a flat additional charge of 35 rupees will be charged.

  •All price mentioned is inclusive of GST and discount.

  •No claim for goods after wash.

  •Goods once sold will not be taken back.

  •If Goods Returned, Then We’ll Not Pay amount in Cash Instead We’ll Refund Amount in i-Pay. And if amount not received in i-Pay after being transferred then customer should contact us within 21 working days.

  •If Goods On Dispatch To Transport Damaged (by any natural calamity or accident) Or Stolen Or Missing, or in any other circumstances not reached to customer, then We Will Not Be Liable For It.

  •In case, if customer gives us advance or any amount is payable to customer by iShop (Indore Dresses Pvt Ltd.), and customer want refund for it then it will be processed within 90 days by transferring amount to i-Pay wallet.

  •Business Hours: 10 am to 7 pm, working days: Monday To Saturday

  •If any essential or not essential contact to inform us made not in business hours, and working days, then it may be ineffectual and we don’t have liability with regards to failure of performance as per information provided not in business hours.

  •iShop (Indore Dresses Pvt Ltd.) Application is platform only to invitation to offer.

  •The primary mode of communication is iShop (Indore Dresses Pvt Ltd.) chatbot, if it not available then whatsapp of official number, official number could be changed with time being. Any communication made on call with our representative will depend on circumstances that whether it is valid or not. And we have right to deem call conversation as ineffective. 

  •If order is placed and payment is not done, and you want to cancel the order, then you must have to cancel the order through iShop (Indore Dresses Pvt Ltd.) application only, call or message notification to us may not considered as effective unless you are unable to cancel. And when notified through call or message, it will depend on us that whether we cancel it or not.

  •Consideration must be in money, we may not accept any other consideration.

  •Our agent or representative, if does extra work to you and charges extra to you, then iShop (Indore Dresses Pvt Ltd.) is not accountable and responsible for that.

  •Unless otherwise agreed, Payment must be made first, otherwise we are not bound to deliver the goods. 

  •If application run by minor as well, then minor will be considered as an agent of the buyer and contract will be valid. And if minor does any mistake in placing order then if order is not cancelled before delivery of goods, then principal i.e., user will be liable to contract. If minor is not agent of principal, then principal must inform iShop (Indore Dresses Pvt Ltd.) to cancel the order, otherwise principal will held liable.

  •Application may have some inconsistent data as for price of goods to product or different image from original image of that product or any other, which we state that we have no control over it, we only upload data to application, but if due to technical reasons, data gets inconsistent with product details, then it will not be our fault and we not intended to deceive any other party. And this issue rarely may occur, so, it does not render contract voidable or give right to other party for rescinding contract, as for not getting goods of description. However, if any advantage as to price is received which seems just, then we may refund gained price to i-Pay, or if any losses suffered to price then if customer purchases that product, customer should pay us actual price which we will share with customer, not price which is shown on portal.

  •On delivery of goods, we deemed to be completed our part of performance, but it does not restrict us to right of lien on goods or right of stoppage in transit or right of withholding goods if we are unpaid.

  •if performance from iShop (Indore Dresses Pvt Ltd.) needed to be exercised on a specific date or time, then buyer must notify us, otherwise on receipt of payment, we may immediately deliver the goods to transport/travels or to any other as agreed.  

 

  •Place to be delivered will be considered as when filled up on signing up, if needed to be delivered to any other place, then must place order with changing delivery address, otherwise, notification of such information may be ineffective on other mode.

  •Document of title to goods may delayed by transport, so, customer should wait for it, until we receive it from transport. And only after that we could share it to customer.

  •We reserve right to retain goods from buyer in case he becomes insolvent.

  •Goods once sold will not be return back in any case, 

  •We reserve right to resell goods if we are unpaid and we may claim damages from original buyer, if sold below contracted price, but can retain profit, if sold above contracted price.

  •Delivery in part will not be considered delivery as whole

  •Buyer may incur expenses to turn goods to deliverable state.

  •Buyer on receipt of goods must inform us within 1 day for its acceptance

  •Buyer is bound to return rejected goods, and if rejected goods is totally consistent with contract and buyer rejects it, then buyer is liable for expenses to deliver goods to iShop (Indore Dresses Pvt Ltd.).

  •Any part delivery made is not to show an agreement to waive lien on goods and we reserve right to lien on remainder goods.

  •Property transfers to buyer when goods is dispatched from premises of iShop (Indore Dresses Pvt Ltd.), otherwise, if goods within premises of iShop (Indore Dresses Pvt Ltd.) Property is of iShop (Indore Dresses Pvt Ltd.)

  •All disputes are subject to Indore jurisdiction.


Returns and Cancellation Policy

1.Returns request will be entertained within 48 hours of goods delivery. Only, in the case of manufacturing defects, replacement requests up to a period of 7 days will be entertained.

2.In case of a return request is placed within 48 hours of goods delivery, where the buyer is not satisfied with the product quality, the goods can be requested to be returned back to iShop (Indore Dresses Pvt Ltd.) by the buyer. We will send the refund amount in his iPay wallet of the iShop (Indore Dresses Pvt Ltd.) Application if return is approved.

3.In case of manufacturing defects, goods can be replaced if request is placed within 7 days from the date of delivery, here iShop (Indore Dresses Pvt Ltd.) may approve or reject the request made. If request got approved, iShop (Indore Dresses Pvt Ltd.) may send replacement with the next order or refund amount in i-Pay, and only iShop (Indore Dresses Pvt Ltd.) has right to chose that either replacement will be exercised or refund will be exercised. If replacement is not exercised, Credit note will be issued and amount will be refunded to i-Pay which can be used against next orders. Refunds in cash will not be given in any case.

4.Returns made for unnecessary reasons will affect customer's ratings on iShop (Indore Dresses Pvt Ltd.). Delivery of the goods, ordered by a repeating customer, will depend on the sole discretion of iShop (Indore Dresses Pvt Ltd.) based on the risk assessment or the past transaction history of the buyer.

Buyer ratings and future supply to the buyer remains unaffected in case of returns arising because of the following reasons:

  o Manufacturing defects or damaged goods

  o Goods received are different from the product description on the website

5.Customer can call us to register their return request. Our customer representative will ask the customer to send a digital photograph of the goods to register their complaint. Our team will provide the customer with all the necessary help required with the return process.

6.All refunds will be initiated to i-Pay and can be used in next orders.

7.In case, part(s) of shipment are returned: Cost of the item and tax levied on the returned item will be refunded. 

8.Under all cases, reverse shipments costs are borne by the customer. 

9.Items shipped in drop-shipment are not returnable / replaceable unless defective pieces and will follow the policy written in point no. 3 above ; Returns for drop-shipment are accepted only at the sole discretion of iShop (Indore Dresses Pvt Ltd.). If returns are approved, the reverse logistics charges are to be borne by the Dropshipper.

10.iShop (Indore Dresses Pvt Ltd.) is a B2B wholesale platform and meant for business buyers only. We do not prefer any end buyers to buy from our platform. All above mentioned facility like exchange / returns / refunds are strictly for business buyers only.



RETURN AN ITEM:

To return an item ordered:

1.Using Call:  Customer can call our helpline number and register a request for return.

2.Using Email:  Customer can email us your return request on: ishop.ind.in.id@gmail.com.

Once a return request is received by iShop (Indore Dresses Pvt Ltd.); a customer service representative will share the return process over a call . They will also explain how to generate a return mailing label and prepare the return documentation, if required.

Alternatively, the Customer can send the goods from any other reliable courier that will deliver to the iShop (Indore Dresses Pvt Ltd.) office on the customer (sender)'s expense.


RETURN PICK-UP:

Our customer service representative will send the customer an e-mail or will inform them on phone explaining the complete return process, and the estimated date on which the return items will be picked up.

ABOUT RETURN DOCUMENTATION:

The courier representative will require the following return documentation, which includes:

•Return Label

•Declaration Form

•Invoice for the items bought



ORDER CANCELLATION:

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our accounts and fraud avoidance department. We may also require additional verification or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after the payment has been charged for, the said amount will be reversed back in your i-Pay wallet. In the event that a non-delivery occurs on account of a mistake by the customer, i.e., wrong name or shipping address, any extra costs towards re-delivery shall be claimed from the customer by iShop (Indore Dresses Pvt Ltd.). Any orders placed for delivery to non-serviceable areas for our Logistics partners will attract additional charges over and above those appearing in normal shipping and will be charged extra. Delivery will be attempted on the best effort basis.

Customer can cancel the Order, if it has not been shipped by iShop (Indore Dresses Pvt Ltd.) already.



DISCLAIMER:

1.Any decision on returns of the product(s) sold by www.ishop.ind.in is at the sole discretion of iShop (Indore Dresses Pvt Ltd.) and the decision of iShop (Indore Dresses Pvt Ltd.) shall be final and binding.

2.iShop (Indore Dresses Pvt Ltd.) reserves the right to withdraw from replacement guarantee at any time without giving any intimation of whatsoever nature.

3.The terms of returns are governed by iShop (Indore Dresses Pvt Ltd.).

4.Due to Import and Export regulations and restrictions, iShop (Indore Dresses Pvt Ltd.) is unable to extend its Returns Policy for any items delivered outside of India.
